Terms of Service

These Terms of Service ("Terms") govern your use of the Japatan mobile application (the "App") provided by the Japatan development team ("we", "us", or "our"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. The Service

Japatan is a vocabulary learning app for the Japanese-Language Proficiency Test (JLPT), covering levels N5 through N1. The App provides flashcard-style study sessions, spaced-repetition reviews, progress tracking, audio playback, and related learning features.

The App is provided for personal, non-commercial educational use. We may add, change, or remove features at any time to improve the service.

2. Eligibility

You must be legally capable of agreeing to these Terms under the laws of your place of residence. If you are a minor, you must have the consent of a parent or legal guardian before using the App and before making any purchase.

3. Premium subscriptions and purchases

The App offers an optional paid plan ("Premium") that removes banner ads, allows unlimited mistakes (no Heart Gems required), and removes the daily word limit. Premium is available as:

• a weekly auto-renewing subscription,
• a yearly auto-renewing subscription, or
• a one-time lifetime purchase.

All payments are processed by Apple through your Apple Account. The following applies to auto-renewing subscriptions:

• Payment is charged to your Apple Account at confirmation of purchase.
• Subscriptions renew automatically unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel subscriptions in your device's Settings → Apple Account → Subscriptions after purchase.
• Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.

Refunds are handled by Apple in accordance with the App Store terms. You can request a refund at reportaproblem.apple.com.

4. Advertising

The free version of the App displays banner advertisements served by third-party advertising networks. Premium removes these banner ads. Advertising is subject to the practices described in our Privacy Policy.

5. Intellectual property

The App and all content included in it — including the Japatan character and artwork, user interface, word lists, example sentences, translations, audio, and software — are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not, except as permitted by mandatory law:

• copy, distribute, publicly transmit, or create derivative works from the App or its content;
• reverse-engineer, decompile, or disassemble the App;
• use the Japatan character or artwork for commercial purposes without our prior written consent;
• extract or scrape the vocabulary database for use outside the App.

"JLPT" is a registered certification of the Japan Foundation and Japan Educational Exchanges and Services (JEES). Japatan is an independent study aid and is not affiliated with, endorsed by, or sponsored by these organizations.

6. Prohibited conduct

When using the App, you must not:

• violate any applicable law or regulation;
• interfere with or disrupt the operation of the App or related systems;
• attempt to gain unauthorized access to the App or its data;
• use the App in a way that infringes the rights of others;
• misrepresent your study progress or rankings through fraudulent means.

7. Learning content disclaimer

We work hard to keep vocabulary, readings, example sentences, and translations accurate, but we do not guarantee that all content is free of errors, or that studying with the App will result in passing any particular JLPT level. JLPT level estimates and World Rank figures shown in the App are approximations for motivational purposes and are not official assessments.

8. Disclaimer of warranties

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, secure, or error-free.

9. Limitation of liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App. Our total aggregate liability for any claim relating to the App shall not exceed the amount you paid to us through the App in the twelve (12) months preceding the claim (or, if you have paid nothing, one thousand Japanese yen). Nothing in these Terms limits liability that cannot be limited under applicable law, including liability arising from our willful misconduct or gross negligence.

10. Changes to the App and these Terms

We may update these Terms from time to time, for example when we add new features or when the law changes. If we make material changes, we will notify you in the App or on this website before the changes take effect. The date at the top of this page shows when these Terms were last revised. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

11. Termination

You may stop using the App at any time by deleting it from your device. We may suspend or terminate your access to the App if you materially breach these Terms. Sections 5, 8, 9, and 12 survive termination.

12. Governing law and jurisdiction

These Terms are governed by the laws of Japan, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance, except where mandatory consumer-protection law in your place of residence provides otherwise.
